BOFA BRANCH REFUSES MY DEPOSIT I got a ride to the branch, but only to be humiliated. I handed my ATM reciept to the teller, and explained that the ATM stole my deposit, and kept my debit card. She refused to deposit the cash from my governement check into my account. She said I could cash the check, but I would have to go outside to the ATM to deposit my cash. I requested the manager assist me, since I had no ATM card. The manager and many tellers kept starring at me as if I was a robber. I waited for the manager for 45 min, and she didn't lift a finger to help me. I eventually left without depositing my check. Maybe they have noted my account as having filed a lawsuit. 5/10/09 BOFA ATM STOLE MY DEPOSIT, AND KEPT MY CARD. BofA's ATM accepted part of my deposit, and printed out my receipt. Then it locked-up and would not return my card. I waiting 40 minutes outside, but it never reset or corrected itself. I was unable to deposit my government benefit check, so I will go into a branch tomorrow. 5/7/09 BANK OF AMERICA, RESCINDS THEIR OFFER After daily communications with the CEO's office, they have decided NOT to settle the case as originally agreed. I had reguested a time-out in order to work with them, but now they are back to their evil ways. I regret giving them the benefit of the doubt. We must demonstrate! 4/23/09 CEO's office makes BIZARRE CLAIMS I called the bofa CEO, and his office manager Michael told me "At this point in time sir, you know, unfortunately we're glad you chose the option of filing suit against Bank of America." He then complained about the website saying "You are illegally using our brand, our logo on that website, so we will certainly address that with you at a later time." Then he went on to say "It's a Federally trademarked logo, which we've not given you authorized use." He then hung up on me. Michael's legal opinion turned out to be totally false. We are free to express ourselves by using such recognizable marks. Bank of America has burned their image into the minds of our society. Now they have been caught commiting intentional acts to harm us. Even after we the people, are share holders in their vicious schemes. We must all unite and use our power of numbers to stop Bank of America, and any other bank who follows their lead. There could be no better time to reform our banks. Especially banks "we" have bailed out with "our" hard earned money. I would like to help create a non-profit group that will aid our efforts. We must identify every individual who is responsible for planning these vicious attacks. Each predator must be exposed to the world for their actions. They have continally shamed us as Americans with their genocidal policies that specifically target the weak. I intend to do everything I can to help this public movement. Please share your suggestions and experiences through this website. More about that soon. 4/21/09 NBC Bay Area News doing story I was contacted by NBC, and I agreed to an interview this week. I'm not sure when it will air, but I promise to have someone post it to YouTube immediately. I want to see a non-profit group created to help other victims of this type of abuse. This is my only reason I considered a settlement. The lawyers have refused to return my calls, so I doubt we will agreee on anything. I'll let you know what happens. Thank you 4/9/09 Victim agrees to resume working with us Bank of America lawyers at O'Melveny & Myers LLP agreed to pay me for my silence, and for all of the video recordings and records of the outragous ordeal. But the bank's lawyer O'Melveny & Myers LLP kept playing games with me and pushed me too far. After all I've have been through, I'm not going to allow some jerk attorney to make money off of my situation, then insult me on top of it. Is this how lawyers are supposed to act? My friends have helped me this far, and justice is not far off. I have a great attorney who can deflect BofA's bull shit back at them. I am happy to say that I am back on board. Thank you for all of you who have shared your life stories of fraud fees. I think it's time to step up the game that they play. If they reply on public funds to bail them out, then we can make them stop cheating people. Just wait until you the recordings that I plan to release to the media next week. Thank you. -Victim #87798343934534534 *** LAWYER ACTION *** Victim was advised not to talk to us. 11/14/08 Followed Up with Customer Service: I called Bank of America today and what until you hear what they said. Check back later for the shocking dialog. Branch Manager Served Lawsuit: Marck claimed he did not have the authority to return my money, but he would pass it forward and see what he could do. I walked out of the bank, and later a process server handed Marck a copy of the court summons and lawsuit. 11/13/08 Visited the Branch Manager Marck Zuehlsdorff: Marck remembered assisting me on Oct. 23rd, but he said that nobody had refrenced my account since. I explained what had happened since the last time I saw him. I hoped that Marck would be the key to getting this corrected, but he said that he lacked the authorization to fix the account. Marck showed me his computer screen which looked very confusing. He continually asked me to make sense of the the data. Several times he reaffirmed that he had initially seen the $35 credit I was given, but had no idea why it didn't post. This credit not posting is what caused the entire fee trap of $600 to kick in. I asked Marck why my account wasn't noted about his attempt to fix the error. He said that there are no notes made when he makes changes to accounts, it doesn't leave any mark. As for the representative who originally issued the $35 credit, he had no idea since he didn't work in that department. Marck was quoted as saying exactly, "we're losing billions of dollars by you guys who are not paying their bills." "What the problem we're in right now in society is people not paying their bills, that's why we are, where we are, so that's why Bank of America is eating a lot, and that's why those fees are inacted, the overdraft fees is cause we have to pay for other people's mistakes." "It's a two-way street, we try and be fair but again you got to understand that especially in an area like Oakland, Berkeley." (he shook his head) 11/07/08 Assistant Vice-President Sarah Valle: Since I didn't hear back from her as agreed, I left her several messages but Sara Valle didn't return my calls. 11/06/08 Lawsuit filed against Bank of America: After several attempts talking with BofA managers and supervisors, I was hopeless about my entire situation. If it wasn't for a kind attorney helping me file a lawsuit, BofA may have gotten away with stealing my entire income, putting me on the street. My disease is terminal I rely on medical treaments daily. After filing my complaint with the court I called the BofA executive relations and talked to Assistant Vice-President Sarah Valle. Hoping to speed up their internal investigation I told Sarah about this website and my lawsuit. At first she blew me off but I explained that BofA still has my money and I needed it immediately for a medical emergency. Sarah said she would investigate my complaint and call me back, but of course she didn't. As it stands now BofA took money from my account that did not belong to them, then to make it worse they are ignoring my medical emergency they caused. 11-03-08 The final word from Bank of America: I called BofA customer service and explained my emergency crisis to Brandy, and her supervisor Pablo who I told about their mistake has caused me a medical emergency. I explained that my card first declined trying to buy groceries. I lost 7 lbs) I explained that the Berkeley branch manager said he would fix it but didn't. Pablo refused to call the manager and his final word was that BofA was keeping my direct deposit of Social Security. Message to BAC Shareholders |
